Privacy Policy

This Privacy Policy is issued by BHGC Houston Scout LLC (Houston), Birdie House Genesis LLC (Dallas), and BHGC OKC Scout LLC (Oklahoma City), each doing business as Birdie House Golf Club (together, "Birdie House," "we," "our," or "us"). It explains what personal information we collect, how we use and share it, and the choices you have.
This Policy applies to our website, our membership and booking platform, our text and email communications, and our facilities. It applies to members, guests, website visitors, and anyone who enters a Birdie House facility. Our facilities are unstaffed, members-only indoor golf simulator clubs that are under continuous video and audio recording, so please read Section 4 carefully.

This Policy works together with our Membership Agreement and our Waiver of Liability, Assumption of Risk, and Indemnity Agreement.
1. Information We Collect
Account and contact information. Your name, email address, mobile number, and any other details you provide when you register for a membership, fill out a form on our website, or contact us by text or email.
Payment information. Your payment card is collected and processed by our payment processor (currently CardConnect). We do not store full card numbers. We receive the card type, last four digits, billing name, and the transaction records needed to manage your account.
Membership and booking data. Your membership type, reservations, credits purchased and used, cancellations and no-shows, membership freezes and cancellations, account activity, and your communications with us.
Facility access data. The door access codes we issue to you and the date and time each code is used to unlock a facility door.
Video and audio recordings. Our facilities are recorded by cameras that capture video and may capture audio, continuously, in simulator bays, common areas, and entryways. See Section 4.
Photos and video for marketing. Photos and video we take at our facilities for advertising, our website, and social media. See Section 5.
Website and device data. When you visit our website, we automatically collect your IP address, device and browser type, operating system, the pages you view, the site that referred you, and information from cookies and similar technologies, including Google and Meta advertising tags. See Section 6.
Communications data. Records of your text message opt-ins and opt-outs, the content of messages sent and received, delivery reports, and emails exchanged with us.
What we do not collect. We do not collect biometric identifiers, and our cameras are not used for facial recognition. We do not collect precise geolocation, health information, or other sensitive personal information. The golf simulator software in our bays (currently GSPro and ProTee) may allow you to create your own account directly with the software provider; that account and any data in it are held by the provider under its own privacy policy, and we do not receive or store it. If we add session recording or swing playback features in the future, we will update this Policy before doing so.
2. How We Use Information
To run the club: create and manage your membership, process reservations and credits, issue access codes, bill the card on file, and respond to your requests.
For safety, security, and enforcement: review recordings and access logs after an injury, incident, property damage, rule violation, suspected code sharing, or unauthorized entry; enforce our Membership Agreement, Facility Rules, and Waiver of Liability; and protect members, guests, and property.
To communicate with you: send transactional messages such as reservation confirmations, access codes, receipts, and service or closure notices; and, only with your consent, send marketing messages such as offers, waitlist alerts, and event announcements.
For marketing content: use photos and video as described in Section 5.
For advertising and analytics: measure how people use our website, measure the performance of our ads, and show ads for Birdie House to people who have visited our website. See Section 6.
For legal purposes: comply with law, respond to lawful requests, pursue and defend claims, work with our insurers, and protect our rights.
We do not sell your personal information for money. We do use advertising tags that share website activity with Google and Meta so we can measure and target our ads; Section 6 explains how to opt out.
3. Text Messaging (SMS) Program
Consent. We send marketing or promotional texts only if you actively opt in, for example by checking an "I agree to receive texts" box on a sign-up form or by texting a keyword to our number. Consent to receive marketing texts is not a condition of membership or of any purchase. Transactional texts, such as access codes and reservation confirmations, are sent as part of providing the service you requested.
Opt-out. You may reply STOP at any time to end marketing texts, or HELP for assistance. We process opt-out requests immediately and maintain a suppression list.
Frequency and rates. Message frequency varies (typically 4 or fewer messages per week). Standard message and data rates may apply.
Transparency. Every marketing text identifies Birdie House and includes clear opt-out instructions, as required by CTIA guidelines.
Record keeping. We log opt-ins, opt-outs, message content, and delivery reports for at least 6 months to satisfy carrier audit requests.
4. Video and Audio Recording at Our Facilities
What is recorded. Our facilities are unstaffed. To protect members, guests, and property, cameras record video, and may record audio, continuously in simulator bays, common areas, and entryways. Cameras are not installed in restrooms.
How recordings are used. Recordings are not monitored in real time. We review them only as needed: after an injury or incident; to investigate property damage, rule violations, code sharing, or unauthorized entry; to respond to a member or guest complaint; and to enforce our Membership Agreement and Waiver of Liability. We do not use facial recognition or other biometric analysis.
Who can access recordings. Birdie House owners and managers, and the camera system vendor that stores the recordings in its cloud service on our behalf.
How long we keep recordings. We retain recordings for as long as we consider necessary for safety, security, and operational purposes, which may be indefinitely. Recordings related to an injury, incident, damage, or dispute are preserved for as long as needed to resolve the matter.
When we share recordings. We may share recordings with law enforcement in response to a lawful request or when we believe sharing is necessary to address a safety threat or a crime, and with our insurers, attorneys, and other parties as needed to investigate, pursue, or defend a claim.
By entering a Birdie House facility, you consent to being recorded as described here and in our Waiver of Liability.
5. Photos, Video, and Marketing Content
We sometimes photograph or film at our facilities for advertising, our website, and social media, including Instagram. Members grant us permission to use their image, likeness, and swing footage for marketing in our Waiver of Liability. Guests and minors are not covered by that permission: we will not feature a guest or minor in an identifiable way without their consent (or a parent's or legal guardian's consent, for a minor), although anyone present may appear incidentally in the background of facility footage. To ask us not to use your image in future marketing, email membership@birdiehousegolfclub.com. We will honor requests going forward but may not be able to remove content that has already been published.
6. Cookies, Advertising Tags, and Analytics
Our website uses cookies and similar technologies, including Google advertising tags and the Meta (Facebook and Instagram) Pixel. These tools collect information about your visit, such as pages viewed, actions taken, your IP address, and device identifiers, and share it with Google and Meta. We use them to measure website traffic, measure whether our ads lead to memberships, and show ads for Birdie House to people who have visited our website. Google and Meta may combine this information with other data they hold about you under their own privacy policies.
Your choices. You can control cookies through your browser settings, including deleting existing cookies and blocking new ones. You can opt out of interest-based advertising from Google at adssettings.google.com and adjust your ad preferences in your Facebook and Instagram account settings. You can also opt out of interest-based advertising from many companies at optout.aboutads.info and optout.networkadvertising.org. Opting out does not remove all ads; it limits ads based on your browsing activity. Our website does not currently respond to "Do Not Track" browser signals.
7. How We Share Information
We share personal information only in these situations:
Service providers that operate parts of our business on our behalf, including our membership and booking platform (currently PlayByPoint), our payment processor (currently CardConnect), our text and email messaging platform (currently Salesmsg), our camera and door-access system vendors, and our website hosting and analytics providers. These providers may use your information only to provide services to us.
Advertising partners (Google and Meta) through the tags described in Section 6.
Legal and safety. When required by law, subpoena, or court order; to respond to lawful requests from law enforcement; to enforce our agreements; to investigate, pursue, or defend claims; or to protect the safety, rights, or property of Birdie House, our members, our guests, or others.
Insurers and professional advisers in connection with an incident, claim, or dispute.
Business transfers. If a Birdie House entity or facility is sold, merged, or reorganized, your information may be transferred to the new owner, who will remain bound by this Policy until it is updated.
With your consent or at your direction. We do not sell or share mobile numbers, SMS consent, or message data with third parties or affiliates for their marketing or promotional purposes. We may share this information only with service providers (e.g., carriers, messaging platforms) to operate our SMS program. Message frequency may vary. Message & data rates may apply. Reply STOP to opt out; HELP for help.
8. Data Security
We rely on established service providers that use safeguards such as encryption in transit and access controls, and we limit access to personal information and recordings to owners and managers who need it. Door access codes are unique to each reservation and expire. No method of storage or transmission is completely secure, and we cannot guarantee absolute security. If a data breach affecting your information occurs, we will notify you as required by law.
9. Data Retention
We keep account, membership, and booking information for as long as you are a member and afterward as needed for tax, accounting, dispute resolution, and legal compliance. Text message logs are kept for at least 6 months, and opt-out records are kept indefinitely so we can honor your preferences. Payment records are kept as required by our payment processor and tax law. Recordings are kept as described in Section 4. Marketing content that has been published may remain published indefinitely.
10. Your Choices and Rights
Marketing texts: reply STOP to any message.
Marketing emails: use the unsubscribe link in any marketing email. You will still receive transactional messages about your membership and reservations.
Advertising cookies and tags: see Section 6.
Marketing use of your image: see Section 5.
Access, correction, and deletion: you may request a copy of the personal information we hold about you, ask us to correct it, or ask us to delete it by emailing membership@birdiehousegolfclub.com. We will verify your identity before acting and will respond within 45 days. We may keep information we need to complete a transaction, enforce our agreements, comply with law, or resolve a dispute, and recordings are handled under Section 4. Residents of states with consumer privacy laws may have additional rights; we honor those rights where they apply.
11. Children
Birdie House memberships and online accounts are for adults 18 and older, and we do not knowingly collect personal information online from anyone under 18. Minors may visit a facility only with a parent or legal guardian as described in our Waiver of Liability. A minor present at a facility will be recorded by our camera system like anyone else; we do not create accounts or profiles for minors. If you believe a minor has provided us personal information online, contact us and we will delete it.
12. Changes to This Policy
We may update this Policy from time to time. We will post the updated Policy on our website and change the Effective Date above. If a change is material, we will also notify members by email or, if you have opted in, by text. The terms of our text messaging program in Section 3 remain in effect for as long as the program operates.
